Topic: 321 Studios Sued for Games X Copy Software

Backed by the ESA, publishers Atari, EA, and Vivendi-Universal sue 321 Studios for violating copyright protection laws.

Yesterday, Atari, EA and Vivendi-Universal filed a law suit against the creator of the game copying software Games X Copy.  Citing its history of software products designed to circumvent copyright protection measures, the companies accuse 321 Studios of violating the Digital Millennium Copyright Act, which makes any attempt to reverse-engineer or otherwise circumvent copyright protection technologies illegal.

The members of the ESA request that 321 Studios be prohibited from making or selling any products that circumvent SecuROM and similar technologies.  They also ask the offending company to retrieve all copies of the software and demand compensation for lost profits.

I think the term to watch out for is "copyright protection". XCopy allowed you to circumvent the copyprotection to excercise your fair use rights defined under the fair use provisions.  This circumvents the copy protection, but not the copyright protection (since fair use is a part of copyright law).

the company will proberly go bankcrupt and start under a new name
may look good on a press release but wont impact much, i remember the "unripperable" ps2 games, which turn b/w heh....they lasted like 2month
