If you read that article you know it doesn't. Format-shifting is allowed for personal use only.
By creating a Mario game and giving it away for free you are in competition with Nintendo using their intellectual property. That is exactly the thing copyright laws are supposed to prevent. By the way, Nintendo managed to kill Giana Sisters, don't you think they could kill a game that is even more a Ripoff of theirs?

The article also says that the only way to ultimately determine if it's fair use or not is in a court of law though.  This line in particular is what I am talking about:

If Nintendo were ever to create their own game for TI calculators, then they would have grounds for a lawsuit I am sure.  But since that's about as likely as me growing a 3rd arm, then Nintendo really doesn't care.

the should make a Toe Jam and Earl remake, that was kinda cool.  Oooh, perfect idea, Simpsons arcade (anyone play this, it was fun) to the gamecube.

I would pay over the top for a remake of Renegade for the Amstrad -that's what I played it on anyway. That was a great co-op game.

Ninja: That calculator can then do things you'd usually have to buy a Gameboy for. That means you're competition.
