Nintendo lift restrictions on 18+ rated content.

I just turned on my 3DS and noticed the following message on the eShop.
 
'Dear Customer,
 
Nintendo has lifted the access restrictions to content rated 18+. Adults can now browse and buy all games at any time of the day.
 
Following analysis of the Parental Controls system on Wii UTM  and Nintendo 3DS TM  in cooperation with USK, the German Entertainment Software Self-Regulation Body, it was deemed that Nintendo's Parental Control system is of very high quality and offers a remarkable level of protection for children. Nintendo's Parental Control system was found to have proved itself in practice.
 
Nintendo always encourages parents to make use of Parental Controls to control access to content they deem inappropriate for their children.

Don't blame Nintendo, the statement makes it clear that they had to convince the USK (since Nintendo of Europen is based in Germany) that their parental controls are good enough to not be restricted to certain times. The USK are just nutty.

I'm not blaming anyone, but these are Nintendo systems we're talking about and Nintendo chose to be based there. As far as I'm aware no other platform holder (Apple, Microsoft, Sony etc.) have been asked to adhere to these ridiculous restrictions. I understand that's probably because their headquarters aren't based in Germany like Nintendo's is, but surely Nintendo must take responsibility for the fact that they ended up in a position where USK could demand something so ludicrous be imposed on the rest of Europe.
 
Ultimately it doesn't matter how Nintendo got in to such a position, or whether or not the decision was taken by another organisation. The fact of the matter is that Nintendo found themselves in a position where they had to limit people's access to content. As the platform holder it's their responsibility to ensure that this doesn't happen.

The other platform holders are not based in Germany, that is why they don't have to. As for why Nintendo doesn't move their HQ to somewhere else in Europe, I don't know. Maybe Germany is giving them big tax breaks or something.
