It's not owned by Sony; it was a joint development project by Hitachi, LG Electronics, Matsushita Electric Industrial, Pioneer Corporation, Philips, Samsung, Sharp, Sony, and Thomson Multimedia.  As for Nintendo using this medium, it would also be alot easier than you think.  Now that the technology is out, obviously Nintendo could easily research it and perfect it to their needs.
