I don't give a **** about paying full price or not, I just want my game. The cartridge battery save is dead and I don't know the know-how to fix it. I was playing through the game on an emulator on my android phone but I made the mistake of installing an os update that reset everything, and the emulator (the only freaking free one with save states enabled) was no longer in the google shop...

My Earthbound cartridge's battery was dead when I bought it used years ago.  I considered returning it since the store I bought it from is very good about refunding defective used games but I thought twice about it considering its rarity.  I was able to get a friend of mine who is familiar with electronics to replace the battery going from a guide online.  The battery replacement is totally doable but you'll need someone involved who knows somewhat what they're doing.

Is there any real threat of a lawsuit or is Nintendo just being overly cautious?

Probably a little of both. Thing is, I'll bet if Nintendo had just confidently released the game on the VC years ago and acted like there was nothing wrong with it I doubt anyone would have taken action, but they've gone out of their way to act like they're guilty, which I think would make it more likely for someone to call them on it.

I've always found the alleged legal issues surrounding a VC release of Earthbound to be sketchy at best. There are other games from that same era with similar issues that have come to the VC, like Chrono Trigger, and those came without incident.

I wish there was a way for the internet to quietly sleep all that stuff under the rug. slowly take down all mentions of what the legal issues might be, tweak wikipedia etc then let Nintendo release the fucking game. All the fans will remain quiet, no one will speak of the music "inspired" by the Beatles and such, we'd be happy - new fans who honestly have no idea about the games history will enjoy a unique and charming RPG, life will go on.. but we'll know.

In a baffling piece of news, Kotaku reports that Virtual Console games on Wii U will not be able to access save files from the Wii versions. This means that if you decide to go ahead and pay that $1/$1.50 fee to upgrade your Virtual Console Wii games to the Wii U versions, you will have have to start over and not work with your existing save data.

There are only two games out of my forty Virtual Console games that I will not upgrade to the Wii U due to the fact that the saves do not carry over and they are Super Metroid and Super Mario RPG. I feel as though the amount of progress I have achieved in those games is not worth the effort to replay. However, if I can repurchase them as a blank slate for the Wii U and not have my old save erased then I might be open to dong this. Ironically, those would have been the first games that I paid to upgrade had the save files been able to transfer over to the Wii U's VC.


How will GBA games be played on the Gamepad? Will the games take up the whole screen? Will Nintendo be emulating the GameBoy player for the Gamecube?

Wait, you say you won't pay to upgrade them, then say you would be willing to buy them? Well, at least with Super Metroid you will be able to buy it for $0.30 in a few months.

You can still transfer them from the Wii to the Wii U and keep the save files, but only if you play the games in the Wii Mode. So you either have to keep them in Wii Mode, or upgrade them and lose your save file (which I suppose is fine for games like Super Mario Bros. which have no real big loss starting over).
