Third parties not allowed to use "Custom" soundtracks?

Okay, this was posted in relation to Godzilla: Unleashed, but seems to apply to third parties in general:

Kind of depressing if true. I wonder why Nintendo would do this on such a, seemingly, mundane feature? It's not nearly as complicated as online, for example, and there was a launch title released in the states that featured it no less...

It's probably not so much a matter of "no, you can't" as it is "uhhh... we haven't streamlined that process to the point where we can let others use it..."

Well it seems really odd they would do this, then again it could be a poor excuse to not include it. I swear though that another game had the feature or is going to use it.

We'll get there. Forever Blue/Endless Ocean will be the second game to use it.

Kinda off track but after watching Blue Planet I became more interested in Endless Ocean.

There better be a technical reason why Nintendo made that decision. I mean, who cares?! Why do they have to be so concerned about something like custom music in games?

...unless they're worried that the RIAA is going to go after gamers for 'facilitating piracy' or something.

I'm thinking good, mellow trance and/or nice n' light Spanish guitar music.

Actually, some classical music (Bach, Beethoven, Mozart) would be real nice. Maybe even some chillax reggae.

Maybe Nintendo just want 3rd parties to actually work on a real score for their games and not just rely on the "let them make their own music" feature?

You guys really think that songs with lyrics will be good to listen to underwater? I don't know, but I had it in my mind that instrumentals (jazz, for instance) would be better suited for such a thing.
