Dave Mirra sues Acclaim over BMX XXX

Can you blame him?

Professional BMX rider Dave Mirra is seeking a minimal amount of $21 million in “damages and injunctions” in an effort to prevent Acclaim from further advertising both Mirra’s name and likeness. The suit, filed last week, is based on Acclaim’s use of Mirra’s name in both print ads and promotions, despite supposed previous agreements to disassociate the biker from the title.

The suit alleges breach of contract, unfair competition, injury to reputation, false advertising and invasion of privacy. It is the latest blow to both Acclaim and BMX XXX, which several large retailers declined to stock during the holiday season because of nudity and other adult content. Acclaim edited out some of that material before BMX XXX hit the market.

Despite shipping over 3 million titles under the Dave Mirra brand, one of the most recent being acclaimed Dave Mirra Freestyle BMX 2, BMX XXX sold less than expected. As a result, Acclaim recently laid off staff, due to the comparatively lower revenue. Alan Lewis, a spokesman for Acclaim, called the suit “baseless”, and assured that the company would defend themselves “vigorously” against it.

Hhahaha, I cant wait for you guys to lose and get such a bad rep that you'll have to close up shop. Your games suck.

That's just mean RABicle. face-icon-small-smile.gif But I would have to agree with you though. Hopefully this will force Acclaim to rethink their business plans and stop putting out games just for shock value. If they make a great game they won't need to resort to shady tactics to get the it to sell. It's a slap in the face to all of us when they pull the crap they have been up to lately. It seems like every game they have put out lately has had some controversy attached to it for one reason or another.

Acclaim hasn't published a game I even consider remotely entertaining since back when they used to publish the home versions of the Mortal Kombat games. And considering those were just ports of Midway arcade games that doesn't mean sh!t (same situation with NBA Jam which I also liked). So personally I couldn't care less if this lawsuit bleeds them dry. We gamers should have sued them years ago for making such crappy games. One advantage to this is that if this lawsuit puts Acclaim in a bad financial situation they may actually be (get this) forced to make a GOOD game in order to get enough sales to get them out of the red.

Now I just need this sort of thing to happen to THQ and 3DO.

They did take his name and everything away, what's his problem? So the game isn't that great, doesn't mean everyone has to keep bashing it into the ground over and over. I bought it, hated the controls and don't play it too much anymore. I can think of many other games that deserve to bashed more than this one. Do you never want to see titties in vgs again? LAY OFF!!!

His problem is that they even though they removed his name from the title they used it to promote the game anyways despite the agreements.

I wouldn't really care if I never saw "titties" in video games again... The other 75% of the net is there for a reason. At least those are real women somewhere.
