Dark Link, this topic seems to be a broken record with the forums.  I would suggest going through the threads before one of the moderators ban you.  However, to save you the trouble, here's your answer based on what was publicized by Nintendo and Rare.

As far as the intellecutal properties, or gaming rights goes:  Rare never attempted to gain the rights to Star Fox or Donkey Kong simply because these were NINTENDO licenses.  The original games licenses created by Rare (Perfect Dark, Banjo, Conker, Jet Force Gemini, etc.) belong to Rare.

The ex-Rare employees issue before the split is true -- Timesplitters is your first clue and Zoonami is your second.  After the split, the facts of those are unclear because there is no publication or documentation to prove such a movement.  Unofficially, that seems to be the word.

Perfect answer, cubist.  Since there's little to be added, I'm locking this down.  Please keep all further Rare discussion to the Other Systems area (or the Game Boy Advance area, when talking about those upcoming games).
