Official Sweepstakes Rules

            1.         Eligibility.

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE ODDS OF

WINNING.  SWEEPSTAKES OPEN ONLY TO RESIDENTS OF THE U.S. (EXCLUDING PUERTO RICO).  IF YOU ARE NOT A RESIDENT OF THESE AREAS, YOU ARE NOT ELIGIBLE TO WIN A

PRIZE, AND NINTENDO OF AMERICA INC. AND PLANET GAMECUBE ("SPONSORS")

RESERVE THE RIGHT NOT TO AWARD PRIZES TO ENTRANTS WHO RESIDE IN OTHER

JURISDICTIONS.  To be eligible to win a prize, entries must be completed and

received by Planet GameCube in the format designed below. Sponsors, their

directors, officers and employees and any of their respective affiliate

companies, subsidiaries, agents, professional advisors, advertising and

promotional agencies, and immediate family members of each are not eligible to

win any prizes. Offer void where prohibited by law. Entries that do not comply

with the foregoing requirements and the other provisions of these Official

Rules will not be eligible to win a prize. All applicable federal, state and

local laws and regulations apply. Offer void where prohibited. Limit one entry

per person per day. No mechanically or electronically reproduced entries will

be accepted.

            2.         Disclaimer.

Sponsors, all participating sponsors and any of their respective parent

companies, subsidiaries, affiliates, directors, officers, professional

advisors, employees and agencies will not be responsible for: (a) any late,

lost, misrouted, garbled or distorted, or damaged entries; (b) telephone, electronic,

hardware, software, network, Internet, or other computer or communications

related malfunctions or failures; (c) any Sweepstakes disruptions, injuries,

losses, or damages caused by events beyond the control of Sponsors; or (d) any

printing or typographical errors in any materials associated with the

Sweepstakes.

            3.         Sweepstakes

Period. The Sweepstakes period is from September 10, 2003 12:00 a.m. EST to October 10, 2003, 11:59 p.m. EST (the “Deadline”). All entries must be

received by the Deadline to be eligible to win a prize.

Three (3) prize winners will

receive a prize package, consisting of the following: one (1) Game Boy Advance

SP retail value ("ARV") $99.99, one (1) copy of Advance Wars 2:

Black Hole Rising for the Game Boy Advance ARV $39.99, (1) deck of Advance

Wars 2: Black Hole Rising playing cards and one (1) Nintendo-branded

T-shirt selected in the sole discretion of Nintendo ARV $15.00.  The total ARV

of the prize package is $154.98.

Odds of winning a prize

depend on the number of eligible entries received.  ALL FEDERAL, STATE AND

LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE

RESPONSIBILITY OF THE WINNER. If you are selected as the winner and you are

under the legal age of majority in your state of residence, one of your parents

or legal guardians must submit a signed, written statement that they have read,

understood and agree to these Official Rules on behalf of you and themselves. 

Any prizes won by a minor will be awarded to the minor's parent or legal

guardian on the minor's behalf.

All prizes will be awarded.

Prizes returned as undeliverable or otherwise not claimed within 14 days after

delivery of notification will be forfeited and awarded to an alternate winner. 

Prizes are not transferable. No substitutions or exchanges (including for cash)

are permitted, except that Sponsors reserve the right to substitute a prize of

equal or greater monetary value for any prize.  All prizes are awarded "AS

IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including,

without limitation, any implied warranty of merchantability or fitness for a

particular purpose).

In the event of a dispute

about the identity of the entrant, online entries will be declared made by the

authorized account holder of the e-mail address submitted at time of entry.  An

authorized account holder is defined as the natural person who is assigned to

an e-mail address by an Internet access provider, online service provider or

other organization (e.g. business, educational institution, etc.) that is

responsible for assigning e-mail addresses for the domain associated with the

submitted e-mail address.  The potential winner may be required to provide

Sponsors with proof that the potential winner is the authorized account holder

of the e-mail address associated with the winning entry.

5.         How

to Enter. Access the Planet GameCube website and click on the applicable

link to go to the entry page. Follow the on-screen instructions and register

for the Sweepstakes by providing all necessary information and clicking the

“submit” button.  By entering the Sweepstakes, you consent to being placed on a

mailing list for promotional and other materials.

6.         Sweepstakes

Rules.  A prize winner will be determined by a random drawing from all

eligible entries, to be held at Planet GameCube on October 10, 2003.

Winners

will be notified via e-mail by October 17, 2003. To claim a prize, winners should follow the instructions contained in their notification.

7.         General

Release. By entering the Sweepstakes, you (and, if you are a minor, your

parents or legal guardians) release Sponsors, participating sponsors, and any

of their respective parent companies, subsidiaries, affiliates, directors,

officers, employees and agencies (collectively, the “Released Parties”) from

any liability whatsoever, and waive any and all causes of action, related to

any claims, costs, injuries, losses, or damage of any kind arising out of or in

connection with the Sweepstakes or delivery or misdelivery, acceptance,

possession, use of or inability to use any prize (including, without

limitation, claims, costs, injuries, losses and damages related to personal

injuries, death, damage to or destruction of property, rights of publicity or

privacy, defamation or portrayal in a false light, whether intentional or

unintentional), whether under a theory of contract, tort (including

negligence), warranty or other theory.

IF

YOU ARE A MINOR, YOUR PARENTS OR GUARDIANS FURTHER AGREE TO INDEMNIFY EACH OF

THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES

DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY YOU.

8.         Use

of Winner’s Name, Likeness, etc. Except where prohibited by law, entry into

the Sweepstakes constitutes permission to use winner’s name, address, likeness

and/or prize information, without limitation, for promotional purposes without

further permission or compensation. As a condition of being awarded any prize,

except where prohibited by law, winners may be required to execute a consent to

the use of their name, address, likeness and/or prize information, without

limitation, for promotional purposes without further permission or

compensation.

9.         Affidavit

& Release. As a condition of being awarded any prize, winners (and if

winner is a minor, winner’s parent or legal guardian) may be required to

execute and deliver to Sponsors a signed affidavit of eligibility and

acceptance of these Official Rules and release of liability.

10.       Contest

Information. For the name of the winner, send a stamped, self-addressed

envelope after October 10, 2003 and before October 10, 2004, to Golin/Harris International, 601 West Fifth Street, 4^th Floor, Los Angeles, CA 90071, Attn: “Advance Wars 2: Black Hole Rising” Winners List. For a

copy of these Official Rules, send a stamped self-addressed envelope to

Residents of VT may omit return postage.

12.       Miscellaneous.

The Sweepstakes and these Official Rules will be governed, construed and

interpreted under the laws of the state of Washington. Entrants agree to be bound

by these Official Rules and by the decisions of Sponsors, which are final and

binding in all respects. Sponsors reserve the right to change these Official

Rules at any time, in their sole discretion, and to suspend or cancel the

Sweepstakes or any entrant’s participation in the Sweepstakes should viruses,

bugs, unauthorized human intervention or other causes beyond Sponsors’ control

affect the administration, security or proper play of the Sweepstakes or

Sponsors otherwise become (as determined in their sole discretion) incapable of

running the Sweepstakes as planned. Entrants who violate these Official Rules,

tamper with the operation of the Sweepstakes or engage in any conduct that is

detrimental or unfair to Sponsors, the Sweepstakes or any other entrant (in

each case as determined in Sponsors’ sole discretion) are subject to

disqualification from entry into the Sweepstakes. If you have any questions
