There could still be a character on the cover, it just doesn't feature a male character.

This should help narrow it down, but, I still have no idea what it might be...

• Not released within two years of the system's launch (so after November 21, 2006)
• Published by a Japanese company that isn't Nintendo
• Not a Puzzle game or an RPG
• No male characters on the front cover

Not published by Nintendo, but a third party.
Primarily controlled by touch
Only game of its series on the DS

Is the game published by Capcom, Konami, Hudson, Namco, Bandai, Square Enix, or Taito? Or there past and/or present conglomerates?

It was also released before October 2010. I think that's all the details.

Sega seems likely, the only other ones I can think of would be Marvellous, ATLUS, Spike Chunsoft, Level 5 and NIS. Level 5's in a bit of a grey area since the games are published by Nintendo in the west, we know it isn't Koei Tecmo, ATLUS mostly falls into the male character on the front + RPG so it should be safe to cross them off.

I really have no idea though, it's a touch driven non puzzle game that wasn't released on any other system.

All the NIS DS games are Puzzle or RPGs.
Spike Chunsoft doesn't have any US released DS exclusives.
Xseed has Ivy the Kiwi that fits I think...

I've wondered that also but then there are times where I think you are just question away from getting it. For instance, if you were to figure out the publisher, I think you'd be able to get the game. So, I'm conflicted as to whether it is too broad or not.

Ivy the Kiwi is on wii, though what if it's this... https://en.m.wikipedia.org/wiki/LOL_(video_game) it fits the criteria I guess.
