Warner Bros. and 5th Cell, the companies behind Scribblenauts, are being sued for their use of two popular internet cat memes in the Scribblenauts games.

Keyboard Cat and Nyan Cat are the two memes in the Scribblenauts games that are the basis for the copyright infringement suit. The creator of Keyboard Cat, Charles Schmidt registered the video that features his now deceased cat Fatso with US Copyright Office in 2010 and has trademarks pending at the US Patent & Trademark Office. Likewise, Nyan Cat creator Christopher Orlando Torres registered a copyright on the Nyan Cat animated GIF in 2011 and has a trademark application pending.

The Scribblenauts series used representations of both cats without permission, starting with Keyboard Cat in the original 2009 DS game Scribblenauts. The most recent Scribblenauts game, Unlimited, contains both memes and is available on the 3DS and Wii U.

King, Holmes, Paterno, and Berliner, LLP are representing the two cats in a combined lawsuit seeking statutory damages, willful infringement enhancements, and attorney fees. However, Keyboard Cat may not be fully eligible due to its late copyright registration. The plaintiffs seek a sales injunction of Scribblenauts games until the suit is resolved.

The case is Schmidt, et al. v. Warner Bros. Entertainment, Inc., et al., CV13-02824-JFW.

This is a cool idea for a feature, but you should consider including the Miiverse IDs of the artists. Since NWR is ad-supported, this page is generating revenue for the site without attribution to the content creators. This is a pretty unsavory practice.


It actually completely blanked my mind to do that when I put this together, so I added it now. Am I still unsavory ? ;D

Watch_Dogs is releasing on November 19 in North America and November 22 in Europe.

Besides the standalone game, purchasers have multiple choices when it comes to what to buy. First off is the big one: the Dedsec edition, which comes with exclusive DLC, a figure of the main character, a collector's box, an artbook, a soundtrack and other assorted goodies. The next biggest is the Vigilante Edition, which comes with soundtrack, the hero's cap and mask, a collector's box, and some of the DLC included in the Dedsec edition.

The Uplay Exclusive edition comes with DLC missions included in Dedsec and a steelbook case. The Special Edition comes with one of the DLC packs from the Dedsec edition.

Watch_Dogs follows Aidan Pearce as he hacks his way through an open-world Chicago.

Nintendo revealed its Wii U Virtual Console launch lineup today on their official Facebook page.

Coming to the Wii U Virtual Console on day one are: Balloon Fight (NES), Donkey Kong Jr. (NES), Excitebike (NES), F-Zero (SNES), Ice Climber (NES), Kirby's Adventure (NES), Punch-Out!! Featuring Mr. Dream (NES), and Super Mario World (SNES).

No specific launch day has been announced, but rumors hint at the end of this week.

More details on Disney Infinity 3DS have recently surfaced including potential Star Wars accessories and its name Disney Infinity: Toy Box Challenge.

Blasters and droids, two things right out of the Star Wars universe, are both mentioned in the ESRB posting, meaning that Star Wars items could be appearing in the game. As of now, this has yet to be confirmed by Disney.

Though already announced to be a party game/mini-game collection, more information about the contents of the game were revealed by a rating posted on the ESRB website. Mini-games will focus on racing, puzzles, fighting, and collecting items. One mini-game mentioned will feature sword battles on a pirate ship, which will most certainly be in the Pirates of the Caribbean area of the game.

Disney Infinity: Toy Box Challenge on 3DS, and Disney Infinity on Wii and Wii U releases on August 18 in North America, and August 20 in Europe.

Reggie dishes on Nintendo's recent successes.

Nintendo has seen a 55% sales increase in Nintendo 3DS games, both through digital and physical copies, says president of Nintendo of America Reggie Fils-Aime.

When interviewed by GameIndustry International, Reggie talked about recent digital success, revealing that 11% of Nintendo's 3DS games were sold digitally.  One success story is the sales of Fire Emblem: Awakening which to date has sold 240,000 copies, with one third of those digital. Luigi's Mansion Dark Moon sales were also highlighted with the total at 415,000 units. Also revealed was the percentage of 3DS owners who have connected to the internet, which currently sits at 67%.

Though not much Wii U info was given, Reggie says that "What I would say about Wii U - and what Mr. Iwata has said - is that the pace of launches has been slower than we hoped. But as we prepare for E3, the pace of launches for Wii U is going to dramatically increase."

Keiji Inafune's Bugs vs. Tanks where insects are fought with tiny tanks during World War II. You can read our Japanese impressions here.  Attack of the Friday Monsters sees players fighting monsters. The Starship Damrey is an adventure game set in space where players take the role of an amnesiac.

The titles are currently listed as ''coming soon'', with no further information given.

Bravely Default is coming to North America and Europe.

Announced at today's Nintendo Direct, Bravely Default is a Squaree Enix RPG developed by Silicon Studio that acts as the spiritual successor to Final Fantasy: The 4 Heroes of Light. It features turn based combat and heavy StreetPass integration allowing gamers to call on encountered players for help.

No release date has been announced for North America while Europe's release was revealed to be coming by the end of this year.

Announced at today's Nintendo Direct, Yoshi's Island for 3DS will be an all new adventure and will feature similar visuals to other entries but in 3D. Besides usual Yoshi moves, including the ground pound, new actions are added that will take advantage of 3DS capabilities.   

No release date is annouced at this time.

Mario & Luigi: Dream Team is releasing in North America on August 11, July 12 in Europe, and July 18 in Japan.

The release date along with new details on the game were revealed at today's Nintendo Direct. This entry sees Princess Peach being kidnapped and taken into the dream world. Players will explore both the real world and the dream world. The dream world is explored by interacting with a sleeping Luigi on the touch screen.

Mario Party is coming to the 3DS this winter.

Revealed at today's Nintendo Direct, Mario Party 3DS will feature new mini-games that test players luck, speed, and concentration, while some mini-games will use AR cards. Another new feature is boosts to dice rolls which help losing players make a comeback.

No specific release date was announced besides this winter.

The Nintendo Game Seminar is returning after a three-year absence.

Starting this July and running until March 2014, the event is a series of game design seminars held for under and post graduates attending universities or technical colleges in the Tokyo and Osaka areas.

The seminars will focus on the newly announced HTML5-based Nintendo Web Framework on the Wii U, which Nintendo hopes will lower hurdles for making games. Coursework will include cover programming, graphic design, sound, and game direction.

Taught by their top employees, Nintendo has run similar seminars since the Famicom era. Previously, Nintendo DS games made at the seminar were made available for download in Japan.

The Legend of Zelda: Majora's Mask may be getting a 3D remake for the 3DS.

A post on Zelda Informer reveals the Spanish online gaming store Xtralife had listed Majora's Mask 3D. The timing of the posting may offer some support for the rumor. A similar reveal happened to Donkey Kong Country Returns 3D before a Nintendo Direct and the next Nintendo Direct is scheduled for tomorrow

Though the page was registered a while ago, Xtralife has been right before, listing the 32 GB Nexus 7 three weeks before its announcement.

Level-5 may be announcing localization of Guild02 titles if a new web page and history are to be believed. 

The page consists of a rotating black box, which when clicked transforms into two smaller rotating black boxes. The last time Level-5 made a site like this, the Guild01 titles where announced for a western release. 

There are three games in Guild02. The first is Bugs vs. Tanks where insects are fought with tiny tanks during World War II. You can read our Japanese impressions here.  Kaiju ga Deru Kinyōbi sees players fighting monsters. The Starship Damrey is an adventure game set in space where players take the role of an amnesiac.

The unconfirmed localization of the Guild02 games may coincide with the upcoming Nintendo Direct. We will be covering the European/North American event this Wednesday.

A gritty Mega Man? It could have happened.

A Mega Man X first-person shooter was in development back in 2010 courtesy of Armature Studio, a studio formed by former Metroid Prime leads.

Codenamed Maverick Hunter, the game would have been grittier take on the Mega Man series, taking inspiration from the Mega Man X games. In the canceled title, Mega Man would have had a sidekick described as a "Bruce Willis-like police officer." Maverick Hunter was originally planned as a trilogy of games.

Maverick Hunter was canceled around the time Keiji Inafune left Capcom, similar to other canceled Mega Man games like Mega Man Legends 3 and Mega Man Universe. Armature Studio is currently working on Batman: Arkham Origins Blackgate for the 3DS and Vita.

The update for Monster Hunter 3 Ultimate on the Wii U that enables Off-TV and cross-region play is due to arrive April 16, .

Off-TV Play allows the game to be played on the GamePad alone, without the TV. Cross-region play lets Europeans play online with Americans and vice-versa.

GameFly lists Game & Wario's release date as June 30.

Though not confirmed, GameFly has been right about Nintendo release dates before, most recently being Mario Tennis Open. June 30 is a Sunday, which is when Nintendo typically releases games. However, it is also the last day of the quarter, meaning it's a good placeholder date, too.

Miyamoto compares the Wii U's struggles to those of the DS.

Shigeru Miyamoto, creator of Mario and Zelda, feels that the Wii U needs time in order for the general public to understand it.

In an interview with CNN, Miyamoto recalls the feelings people had when the DS came out and expresses his belief that the situation with the Wii U is similar, saying, "I almost feel like, as people get more familiar with Wii U and these touchscreen interfaces, that there is going to come a point where they feel like, 'I can't do everything I want to do if I don't have a second screen.'"

Club Nintendo's April game rewards are Super Mario 64, Super Metroid, Kirby's Pinball Land, and 3D Classics: Urban Champion.

Super Mario 64, originally released on the Nintendo 64, is the beloved 3D platformer that arguably perfected the genre in the first go-around. Control Mario as he journeys through multiple destinations all in one castle to save the Princess. For 200 coins, you can play the 1996 sensation on your Wii or Wii U in Wii Mode.

Super Metroid follows the journey of Samus Aran on an intergalactic adventure filled with lots of weapons upgrades and a great soundtrack. This SNES title can be yours for 150 coins. This game is playable on both the Wii and the Wii U's Wii Mode.

Kirby's Pinball Land, the 3DS VC release, has Kirby playing the role of a pinball. There are three different tables to play on plus a secret bonus games. Don't disappoint the pink puff and grab this title for 150 coins.

3D Classics: Urban Champion, on the 3DS, lets you play the game Urban Champion in 3D. That's really it. It's Urban Champion. Pick this one up for 150 coins.

All four games will be available until May 5.

No tea-tables "officially" upended.

The original bosses of Luigi's Mansion: Dark Moon were thrown out by Shigeru Miyamoto.

Known for his "upending of tea-tables" (making dramatic changes during the development process) Miyamoto canned the original bosses and had Next Level Games create new ones early in development. This was revealed in an interview with the developers of Luigi's Mansion: Dark Moon on IGN.

Next Level Games' Brian Davis notes that the studio had only one boss had been completed, but the others had been designed. "What he wanted for that was, he wanted bosses that could only be in Luigi’s Mansion," Davis tells IGN. "If you saw a boss, you’d say, 'That’s a Luigi’s Mansion boss!' I think that was the right choice. It allowed us to be very creative."
