So... What were some of the details on these past cases?  Like, can you remember specific companies involved?  Defendants?  Any specific game titles?

For the love of god, you know damn well he's not going to admit he was wrong, and no one here needs to be convinced that he's a pompous know-it-all ass, so really all you're doing is annoying the rest of us.

It's like piracy. TJ Spyke is a dirty rotten pirate, and UncleBob, the moderator/publisher, is trying to stop him, but the measures he's taking aren't stopping TJ Spyke from being a horrible poster, and are only serving to interfere with normal, law abiding forum members.

What I'm basically saying is that UncleBob=EA.

Amazing stuff. I better make sure not to record any videos of my kids playing with Nintendo toys or riding their bikes and put them on YouTube, or TJ will attack me for copyright infringement. I'll get scared when he says people have been sued for doing that and swiftly take down my videos.

If only there was some kind of online encyclopedia that would have links to information about what is Fair Use and what is not, maybe citing court cases if there are any...some type of encyclopedia where people could find new information and add it, like a wiki. Do you think TJ knows any sites like that?

I would love to see what he comes up with since I am pretty sick and tried of him making baseless assertions, not putting up and running away. Not forgetting the constant strawmanning, deflections, selective reading, context hiding and the bloody worse of all "Because TJ said so".

But this goes beyond that.  I'm not even asking TJ to back up his opinion or to prove someone else's opinion wrong.

TJ came into thread and stated "facts".  These "facts" were supposed to be based off of "past cases".  I'm asking for details - any details - about these "past cases".

I'm merely asking TJ to provide the information that he claims he read.

For a guy who pops into any assortment of threads and adds little facts, details or corrections that he says he doesn't get off of Wikipedia, he should be able to provide *something* about these cases he read about.

That's all I'm asking for.

If these cases really do exist, I'd like to read more about them.  If they don't exist, then TJ should just come forward and say "They don't exist."

And seriously, if I wanted to really pick on TJ, I'd point out the irony in him giving his uneducated (as in no legal schooling) opinion on the legality of something and expecting anyone to agree with him, then saying that the article that oohhboy provided shouldn't mean anything because it's just the opinions of someone who doesn't know anything about copyright law... then, when it's pointed out that the individual is very educated in copyright law and has fought several cases, well, the opinion still shouldn't count because even Supreme Court Justices can't agree on what's legal.  Or something.

But I didn't point that out - because I just want him to provide the factual information that he said he read about so that I can read it as well.

For example, when I talked about a specific case, I actually gave details from a specific case (http://www.nintendoworldreport.com/forums/index.php?topic=42067.msg800428#msg800428).  I did this because I respect my fellow peers here on NWR well enough that if they actually want to read up on it, then I'm giving them enough information to do so.  I'm not just going to sit back and expect anyone to just blindly take my word for it.

Back to these "past cases" - I haven't been able to find anything and I'm surprised that none of the articles that have ran on any of the gaming sites that I've read since the initial story broke even referenced them.  Now, current gaming media is... lackluster to say the best, but it's odd that not even the comments sections anywhere seem to specifically reference any past cases.

Therefore, I'm relying on TJ - as the only person who seems aware of the situation *and* has knowledge of these "past cases" to share his information to such a point to where I can do my own reading and research on them.  It's not unreasonable.

And if they don't exist, then all that needs to be said is "They don't exist."

The another option is to go on a hate and shame campaign until TJ never shows up again. It would be fun as hell, but be considered To Fartm and would never get our answers.

Mind you, we have been through this cycle several times already where TJ gets himself in an indefensible position, we call him on it. Instead of backing down like a normal person he doubles down, it blows up in his face and we get left with the clean up bill.

He merely said he was "having trouble finding" the cases.  Which is pretty understandable - so I asked for any details he could offer, like names of games, developers or anything, so that I could try and research these cases myself.

You tell me - what would have been the better route:

A) Simply assume TJ was providing accurate and honest information when he cited "past cases", even though he has shown to have issues understanding and relaying what he's read in the past?

B) Just ignore TJ and not even attempt to have a conversation with him?

C) Call him out as a liar on the spot and not give him a chance to provide the information he may have?

And for the record, I originally only asked him three times.  I first asked him to cite the cases (that's one), where he then claimed he was having trouble finding them.  I questioned him on the fact that he couldn't cite the cases (that's two), to which he again reiterated that he couldn't find them and was going off memory.  So, giving him the benefit of the doubt, I then asked him for any details he could remember about the cases (that's three) - because, why would you remember the outcome of a case, but not remember something like who was involved or what it was over?  TJ then responded to a lengthy post that was made after mine by another member - and made no effort to address my simple question asking for clarification on his claim about the existence of previous cases.

I *could* have let it go then.  A bigger man probably would have.  But this is after, multiple times in that very thread, that TJ just skipped over any points he just couldn't say something against.

Like when I asked about CurtDogg's Backlogg.  TJ said that was different, because he/NWR isn't making money on it.  I pointed out that they were, because they're making money from ads on the site where it's shown.  TJ then said *that* was different, because CD/NWR is making money on ads from the advertising company - which is "a shady area, but not as bad as the LP."  I pointed out that making money from ads is the EXACT SAME THING that LP's do and the ENTIRE basis of this whole deal between Nintendo/YouTube/Let's Players.

TJ then continues to try and make his argument, but makes ZERO effort to address his VERY ON contradiction.  Doesn't even acknowledge it.

Now, *that* is based on his opinion.  So, whatever - TJ has a conflicting opinion about something.  It's his opinion and his right to do so.  Even if it makes no sense.

But when TJ started citing facts from these "past cases", then I should have the right to question him.  If he's going to present historical data as a fact to back up his opinion, then he should have to let everyone see that same historical data.  Who knows, I might read it and agree with him!  I mean, we're talking about the outcome of a court case, after all.  Not much to debate there.

If you say "Dude, don't eat that Big Mac.  It sucks.", then I'm not going to press you too much on your opinion.  If you say "Dude, don't eat that Big Mac!  McDonald's uses ground up babies for the meat!", then yes, I'm going to press you for some kind of evidence.

Now, mind you, this is all after TJ came on here, calling someone just flat out crude and horrible names because he misread an article she wrote - and still hasn't apologized for it or admitted that he was wrong (in fact, I think he's still under the belief that he's in the right about that).

You did a much better job than normal. To be honest, sometimes I feel like you respond to TJ's asshatery with bullying, but definitely not this time.

Besides, it's not about "winning".  I'm not trying to "win" - there's no prizes involved, so to "win" would be pointless.
