Nintendo Gaming / RE:LMAO, Sony losing it!
« on: April 01, 2005, 03:54:33 AM »
While it's true Sony is in a lot of hot water at the moment, they're nowhere near doomed. Sure, I'd love to fall into the spell our old friend AgentSeven is under, but it's just going too far. I would love to see Nintendo pull ahead in the next generation, standing tall like they did in the late 80's. Unwrapping that NES at Christmas was the greatest thing ever. Nothing else came close to it, nothing else mattered. It was all I needed, it made me happy in the darkest of times. Like the Christmas after.... God I hate Christmas..

I'm sorry, I'm rambling. I've had a bit to drink tonight.
And no, this isn't my return to Planet GameCube. I just thought I'd pop in to see what's going on today and as per usual... not much worth coming back to.

Oh please.  That's like me saying that I would rather we just go out and ass rape all the prisoners ourselves, rather than locking them up.  All I'm saying is do your bloody jobs.  All you've done in the time I've been gone is make a complete mockery out of all the rules here.

And just for the record, pointless spam is not as fun as you might think.

I left this place long ago because I felt that the moderation was down the toilet and there wasn't any reason for me to remain here.  Since I've left, I've kept in contact with the diminishing number of people here that I felt were worth talking to, but I HAVE BEEN AWARE of what has been going on among the moderators, and the continuing decline of anything resembling moderation in the slightest.

It doesn't really bother me anymore that one of the biggest asses I have the displeasure of knowing on the Internet "moderates" here.  It doesn't even bother me that Ty seems to have some sort of ridiculous thing in his sig that I thankfully don't have a plugin installed for (I've heard it's some obnoxious sound).  It doesn't even bother me that such things are against the forum rules.  But it DOES bother me that all the other moderators are beginning to take a page from his book, even Bloodworth who I used to have a lot of respect for.

Btw, forum rules that are broken by one or more moderators since I have left, who are supposed to set an example.

You may add a custom avatar (also called a "author icon") to your profile.  It should be no more than 100x100 pixels in physical size, and no more than 20KB in data size.  It should not contain any offensive graphics or needless animation

You agree that you will not use our forums to post any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violative of any law.

* Spamming the board for the purposes of inflating your "post count."

Knowingly antagonizing moderators or other forum users, or posting "flame bait" (i.e. Trolling).

The following topics are off-limits unless specifically approved by a moderator, and will result in the thread being deleted.  Any reposting of these off-limits topics will result in the user being banned:

* Religion
* Politics
* Nationality
* Sexual Orientation

These rules apply even in the "General Chat" areaa of the Forum. Do not use that as an excuse to break the rules. All "General Chat" means that conversation is less-structured, and does not have to be video-game related. The standard rules still apply.

Indeed, I dare not even dream of that =\  It is really stupid, Enix OWNS Japan, they make the console... why not Nintendo's?

Enix has always had a wait and see approach.  They let the console makers fight it out for a year or two, and then they make Dragon Quest for the console with the highest installed userbase.

Nintendo Gaming / RE:Silicon Knights and Nintendo break up
« on: October 09, 2004, 11:59:09 AM »
I went to PAX (Penny Arcade Expo) this year.  One of the features of the event was that people who worked in the industry came and talked to us for a bit about various different stuff, like the game development process, and how to get into the industry.  A couple of the panelists worked with Silicon Knights on Eternal Darkness, and seemed to know the people inside fairly well.  I took the opportunity to corner one of them afterward, and although he tried to run away, I managed to trap him.  I relentlessly asked about what Silicon Knights had planned for the future, and wouldn't take "I don't know" for an answer.  (Most especially, I asked about what platforms they were developing for).  He finally relented in order to get rid of me, and told me that he knew that Denis liked Nintendo.  Which of course was a complete cop out answer, but he delivered it in a manner that suggested that any Silicon Knights games made in the near future would likely be on Nintendo systems, but he seemed to think that the best marketting strategy would be to develop multiplatform.  (He also believed that Metal Gear Solid: The Twin Snakes would have sold millions on PS2).

Man, now I almost regret buying the Classic NES GBA SP (although I don't... that thing's a piece of history).  Because that GBA above just looks mighty sexy.

Shut it woman.

The characters are works by themselves, every piece of art in a game is a work. The concepts are works. Making a derivative work of a copyrighted work, in this case a 3d model based on a concept by Akira Toryama, is enough to cross the line. You're using the most lenient way of interpeting the law, that wouldn't hold up in court, they'd argue that "tribute" means "copy" and that just learning from doing it isn't enough for "educational use" (since you invariably learn something from making an adaption, you get better at making adaptions). That they didn't just use excepts from the characters but the whole characters. Yes, arguing semantics is exactly what's done in court, but I'm sure the other attorney could find a whole lot of points to be used against you, as well.

Yes, I am not denying that some copyrighted material was used in CTR.  But that's exactly my point.  Fair use allows people to use copyrighted material in their own projects if it's not blatantly infringing.  Fair use is a really grey area thing though, and I am saying that if it was contested in court, then CTR might very well win.  They aren't doing this most likely because none of them want "copyright infringer" to go on their record.  Which really really sucks.  Square Enix probably knows this, and that's why they did it in the first place.  And THAT is why I am currently boycotting them.

Well fine then, here's fair use straight from the US Government's mouth.  (NOTE TO MODERATORS:  Facts may not be copyrighted, and as a result, I am free to directly quote the link above.   )

the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes

it's non-profit, and educational in the sense that all the people involved with development are learning a great deal.

the nature of the copyrighted work

a tribute.

amount and substantiality of the portion used in relation to the copyrighted work as a whole

10 scenes from the game.  I would suspect them to be short scenes.  None of the original artwork or code was used, meaning that story, characters, and dialog were used from the original.  I would say that the amount would actually be pretty small, something akin to fanfictions.

Quote

the effect of the use upon the potential market for or value of the copyrighted work

Given that this was not intended to be a full game, I can't see where it would do much other than to drum up some extra publicity for Chrono Trigger.

KDR, I believe that CTR was probably protected under parody law.  It's the part of fair use that allows idiots like Puff Daddy to exist.

I find it incredibly hilarious that you're arguing about fair use by copying and pasting an entire article in our forums, which is strictly prohibited. Give a link to the guy's page for crying out loud. - Bloodworth

TalkBack / RE:DS Software Can Access GBA Slot
« on: September 11, 2004, 12:15:06 PM »
as a GBA homebrew developer, and someone who's pretty interested in Nintendo's newest... I have to say that I am QUITE intrigued at this possibility.  I knew when I bought my GBA flash cart that it would probably need upgrading when the DS came along, but now, the possibility of running DS code on my GBA flash cart is QUITE intriguing, to say the least.

Obviously, this hardware capability is intended to read from existing GBA games, such as transferring save files from Golden Sun GBA to Golden Sun DS, or things like that... but if it can be modified to allow homebrew code, then it would be quite good for me.

However, the downside of that is that it makes it quite easy to hack the system GBA-style.  I fear for early piracy on the DS, as we saw on the GBA.

nay, they killed FF Tactics with Final Fantasy Tactics Advance.  I think I am about done with Square now.  Let's just hope they fade to Acclaim status in a timely manner.  The industry would be better off.

Square never heard of Fair Use I take it?  Stupid bastards... I think I might just vote with my dollar on this one.  I wasn't buying many Square games as it were, but I think this has just guaranteed that I will NOT be buying Final Fantasy 1&2 at the very least.

TalkBack / RE:Acclaim Files Bankruptcy
« on: September 02, 2004, 12:14:04 PM »
If there were any game developer who deserved to go bankrupt, it would be Acclaim.  They've been around since forever, but they have never really developed anything special.  It was Acclaim I believe who made/published Narc.  This was a pretty good arcade game I hear, but on the NES, it became known as the game (coupled with some Friday the 13th), that turned me off action games for a very very long time, until the N64 came out, and I started to find that action games were fun again.  (Especially ones not developed by Acclaim).

I have no real fondness for the company, as their only games that I really liked were either ported from something made by another developer, or simply published by a small developer (ie. Burnout).  Years and years of crappy games just sort of tarnishes the reputation of any developer.

But I am still somewhat sad to see them go though, even after all their attrocious games and lousy business practices.  The world now has one less game developer, be they good or bad.  Somehow I suspect that in Acclaim's case, the real problem with them was management and not really talent... and I wish all the staff employed by Acclaim well, and hope that they can move on to actually accomplishing great things.

well, that may be, but at least my avatar isn't wearing a tutu.  (Perhaps you could convince your avatar to loan you a party dress?  I'm sure that he/she/it would have an extra)

well, I dunno, I see that... erm... thing wearing something that's entirely not unlike a tutu.  Looking down at my own legs, I see something that looks entirely like blue jeans.  I'm just not seeing where you are getting these accusations from.
