There have been homebrew levels for NSMBWii for a while, and I don't think Nintendo's done anything about those. It seems like the kind of thing that's not worth the trouble for them, and taking any action would only draw attention to it, which would get even more people to install homebrew.

I'll be interested when something playable shows up. I'm not convinced they'll be able to do 3D level design super well. It's way more complex than doing new super mario bros wii levels.

Bob Bomb's Battlefield looks fantastic.

They've also managed to port Sunshine levels. Cool stuff.

All things considered, though, I don't know why anyone with any talent in game design would want to spend the hundreds if not thousands of hours it takes to make assets and content for a something they don't outright own and has incredibly limited distribution potential.  I mean, making rom hacks just seems... hack. ;D

Especially since they would not be able to make any money (they try to charge, and that removes any doubt that it's a copyright violation and they can expect a lawsuit).

I don't believe they have to actually make any assets. Also, they may be doing it for a hobby or they work as developers on other stuff and are just having fun with Mario cause they'll never be able to make a Mario game.

Which would be stupid since it would draw more attention and give more reason to shut it down. Legally Nintendo has the right to shut it down anyways.

It would make them look bad to the few people who know about it, and those people are still going to buy Nintendo games so it doesn't matter. It's like square shutting down 3D remakes of chrono trigger or the sequel to chrono trigger or nintendo shutting down the 3D Link to the Past. It sucks for the people that cared, but that is not a lot of people and it isn't stopping any of them from buying new zeldas or mario games or new Square Enix RPGs.
